1. Introduction

Welcome to M87AI ("Service"), a chatbot platform and interactive AI service developed and operated by Cosmic Intelligence, LLC ("we," "us," or "our"). M87AI leverages various AI models and technologies (including but not limited to OpenAI, Google Gemini, and Anthropic) to provide automated responses to user queries. By accessing or using M87AI, you agree to comply with and be bound by these Terms of Service ("Terms").

If you do not agree with any part of these Terms, you must not access or use M87AI.

2. Eligibility

You may only use M87AI if:

  • You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher); and
  • You have the legal capacity and authority to enter into these Terms.

By using M87AI, you represent and warrant that you meet all the eligibility criteria stated above. We do not actively verify user age and rely on your representation.

3. Acceptance of Terms

By accessing or using M87AI, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws. If you do not agree, you should immediately stop using the Service.

4. Modifications to the Terms

We reserve the right, in our sole discretion, to change, modify, or update these Terms at any time. When we do, we will post the updated Terms on our website or within the Service and update the "Last Updated" date at the top of this page. Your continued use of M87AI after any such changes constitutes your acceptance of the revised Terms.

5. Description of the Service

5.1 General Functionality

M87AI is an AI-powered chatbot that allows users to interact with artificial intelligence language models. It can provide responses to user queries, offer ideas, and facilitate discussions. M87AI is not a substitute for professional or expert advice.

5.2 AI Outputs

M87AI's outputs are generated using large language models from third-party providers. These responses may not always be accurate, complete, or up to date. You acknowledge that all outputs and responses are provided on an "as is" basis and may potentially be offensive or inappropriate.

5.3 Updates and Improvements

We may, at our discretion and without obligation, update, improve, or change the functionality of M87AI. We do not guarantee that any specific feature or portion of the Service will always be available.

6. User Conduct

When using M87AI, you agree NOT to:

  • Violate any applicable laws, regulations, or these Terms.
  • Use the Service for any unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable purpose.
  • Attempt to gain unauthorized access to, interfere with, or disrupt any servers or networks connected to M87AI.
  • Transmit viruses, malware, or other malicious code that could harm M87AI, other users, or third parties.
  • Collect or harvest any personal data about other users.
  • Use M87AI to generate or share content that infringes on any intellectual property or privacy rights of a third party.
  • Engage in any activity that could damage, disable, or overburden the Service.

We reserve the right to suspend or terminate accounts that violate these Terms or for any other lawful reason, as determined in our sole discretion.

7. Privacy

Your use of M87AI is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using M87AI, you consent to all actions taken by us concerning your information in compliance with our Privacy Policy. We utilize HTTP-only cookies for authentication and session management, store conversation logs, and maintain other data necessary for user account functionality and service improvement.

8. Payments & Refunds

8.1 Payment Processing

If you subscribe to or purchase any paid features or services through M87AI, all payments are processed by Stripe on our behalf. We do not store any payment or credit card details on our own servers.

8.2 No Refunds

All sales are final. We currently do not offer refunds for any subscription fees, one-time purchases, or other charges. By making a payment, you acknowledge and accept this no-refund policy.

9. Intellectual Property

9.1 Ownership

Cosmic Intelligence, LLC and its licensors own all rights, title, and interest in and to M87AI, including any underlying software, technology, and content (except for content provided by users).

9.2 User Content License

By submitting or transmitting any content ("User Content") to M87AI, you grant Cosmic Intelligence, LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to store, display, process, and use your User Content in connection with operating and improving the Service.

9.3 Trademarks

All trademarks, service marks, logos, trade names, and any other proprietary designations used within M87AI are the property of Cosmic Intelligence, LLC or its licensors.

10. Disclaimers

10.1 No Warranty

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Accuracy of Information

We do not guarantee the accuracy, completeness, or timeliness of any information or data provided by M87AI. Any reliance on such information is at your own risk.

10.3 No Professional Advice

M87AI is not a substitute for professional advice (e.g., legal, medical, financial). Always seek the guidance of qualified professionals before making decisions based on the outputs generated by M87AI.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

  • No Liability for Indirect Damages. Cosmic Intelligence, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of M87AI.
  • Aggregate Liability Cap. In no event will Cosmic Intelligence, LLC's total liability exceed the amount you paid us, if any, in the 12 months preceding the event giving rise to liability or one hundred US dollars (USD $100), whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Cosmic Intelligence, LLC and its affiliates, officers, directors, employees, and agents from and against all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of M87AI or any activities under your account;
  • Your breach or alleged breach of these Terms;
  • Your violation of any law or the rights of a third party.

13. Third-Party Services

M87AI may integrate, incorporate, or otherwise link to third-party services or AI models (e.g., OpenAI, Google Gemini, Anthropic). We do not endorse or assume responsibility for such third-party services. Your interactions with these services are governed by their own terms and policies. We have no control over and assume no liability for the content, privacy policies, or practices of any third-party providers.

14. Data Storage & Retention

14.1 Types of Data

We collect and store user account details (name/username, email, bcrypt-hashed password), chat logs, cookies for session management, and certain technical data (e.g., IP address, device/browser information).

14.2 Retention Policy

  • Indefinite Storage: Chat logs and other user data may be stored indefinitely unless you request deletion or close your account. A future feature may allow manual deletion of specific chat logs.
  • Session Timeout: Session data expires after 45 minutes of inactivity.
  • No Automatic Purge: We do not currently offer an automatic data purge schedule. Data is retained for user convenience, service improvements, and debugging.

14.3 User Deletion Requests

If you wish to delete your account or request the removal of your data, please email root@cosmicai.dev. We will handle these requests in accordance with our Privacy Policy and applicable laws.

15. Term and Termination

15.1 Term

These Terms remain in effect as long as you use M87AI.

15.2 Termination by You

You may stop using M87AI at any time.

15.3 Termination by Us

We may suspend or terminate your access to M87AI at any time for any reason, including but not limited to a violation of these Terms.

15.4 Effect of Termination

Upon termination, your rights to use M87AI will immediately cease, and you must discontinue all use of the Service.

16. Governing Law & Dispute Resolution

These Terms and your use of M87AI will be governed by and construed in accordance with the laws of the United States and the state in which Cosmic Intelligence, LLC is organized or headquartered (as determined by us), without regard to conflict of law provisions. Any disputes arising out of or in connection with these Terms will be resolved exclusively in the courts located in that jurisdiction, unless otherwise required by applicable law.

17. Changes to the Service

We reserve the right to modify, suspend, or discontinue M87AI (in whole or in part) at any time, with or without notice to you. We will not be liable to you or any third party for any such modifications, suspension, or discontinuation.

18. General

  • Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No Waiver. Any failure by us to enforce any right or provision under these Terms does not constitute a waiver of future enforcement of that right or provision.
  • Entire Agreement. These Terms, along with any other agreements referenced herein (including our Privacy Policy), constitute the entire agreement between you and Cosmic Intelligence, LLC regarding your use of M87AI.
  • Assignment. You may not assign or transfer these Terms or any rights or obligations herein without our prior written consent. We may freely assign or transfer these Terms.
